Terms of Use

These terms govern use of the Gloss iOS app (“Gloss”) published by SMOOTHIE WEB DESIGN LIMITED (“Smooth”, “we”, “us”). By downloading or using Gloss, you agree to these terms and to our Privacy Policy.

If you do not agree, do not use the app.

The service

Gloss is a bilingual reading app for learning English or Spanish through public-domain books. Features include tap-to-translate, saved units, audio review games, and optional chapter downloads.

Free plan. You may read the first numbered chapter of each book (and published front matter where offered) without a subscription.

Premium. A subscription unlocks the rest of the catalogue, downloads, and related Premium features described in the app.

We may add, change, or withdraw books, translations, or features. Public-domain source texts are not owned by Smooth; our work is the app, the presentation, and the learning layers (alignments, glosses, audio packaging, and similar).

No account

You do not create a Gloss account. Progress, settings, and saved words live on your iPhone. They are not backed up to Smooth. If you lose the device or delete the app, that data may be gone. Apple subscriptions can be restored on a new device signed in with the same Apple ID.

Subscriptions (Apple)

Premium is sold as an auto-renewing subscription through Apple In-App Purchase.

The price you pay is the price Apple shows in your App Store storefront at purchase (including applicable taxes). Payment is charged to your Apple ID.

• The subscription renews automatically unless you cancel at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel in iPhone Settings → [your name] → Subscriptions, or via Manage in App Store in the Gloss Settings screen.
• Any unused portion of a free trial, if offered, is forfeited when you buy a subscription.
• Restoring purchases re-links an existing Apple subscription; it does not create a new charge.

Smooth does not issue refunds for Apple charges. Refund requests are handled by Apple under Apple’s policies.

Licence

We grant you a personal, non-exclusive, non-transferable licence to use Gloss on an iPhone you own or control, in line with the App Store terms. You may not copy, reverse engineer, scrape, or redistribute the app, our audio packages, or our translation layers except as allowed by law.

Acceptable use

You agree not to misuse Gloss (including attempting to bypass the paywall, attack our content host, or use the app in a way that breaks the law).

If you submit a translation report, you grant Smooth a licence to use that report to review and update our content. Do not include personal information in the details field. Reports are optional and do not create an account.

Intellectual property

The Gloss name, app, design, packaging of content, translations, audio production, and software are owned by Smooth or our licensors. Underlying book texts that are in the public domain remain in the public domain.

Disclaimer

Gloss is a study aid. Translations and notes are provided as-is and may contain errors. We do not guarantee fluency, exam results, or uninterrupted availability of downloads.

To the fullest extent permitted by Irish and EU consumer law, Gloss is provided “as is”. We are not liable for lost progress stored only on your device, or for Apple’s handling of payments. Nothing in these terms limits liability that cannot be limited by law (including for death or personal injury caused by negligence, or fraud).

If you are a consumer in the EEA/UK, you keep your statutory rights.

Changes and termination

We may update these terms. The effective date will change. If you keep using Gloss after an update, you accept the new terms.

We may suspend access to content or Premium features if we reasonably believe these terms are broken. Cancelling a subscription stops future renewals; you keep Premium until the end of the paid period.

Governing law

These terms are governed by the laws of Ireland, without prejudice to mandatory consumer protections in your country of residence.
